Growing Pains Ailing Round Top
The Round Top town council held a meeting Monday still trying to catch up after the antiques shows and failure to obtain a quorum the week before.
Mayor Barnell Albers said Tuesday that the town has hired attorney Cary Bovey of Round Rock to provide legal counsel on an “as needed” basis.
Concerned about the proposed “Round Top Shops” planned for the highway frontage along SH 237 south of the city limits, Albers said the council asked Bovey if the town’s land use ordinance could be enforced if the area in question were included in an “extra-territorial jurisdiction” or ETJ. His answer was “no,” the only enforceable ordinance would be the subdivision ordinance if a subdivision were planned. This is unlikely, as the area is in the flood plain of Cummins Creek. The elevation of the area of the planned shops will be raised enough to comply with the floodplain ordinance.
