Round Top Still Sorting Through Ordinance Controversy

The Round Top town council continued to wrestle with  the   town’s Land Use Ordinance Monday in a meeting that got a bit contentious toward adjournment. 

The ordinance, first passed in the 1990s after a series of public hearings, some of them heated, was amended several times in subsequent years also after public input. At some point,  the date is not clear, the public hearing part of the amendment process  was neglected or abandoned and changes proposed by the architectural review board or members of the council were adopted without legally-valid public notice or input.

According to the town’s current attorney, municipal law specialist Cary Bovey of Round Rock, who was hired to help straighten out the legal status of the ordinance, actions taken by the council over the years to amend the ordinance without formal and properly posted public hearings are unenforceable – in legal terms,  “null and void.”
